We’re often told that the law is confusing and so have written several blogs explaining the underlying process for various aspects of the legal services profession.  One of the most common areas that we’re asked about is litigation.  So here, it’s about time we answered the question we’re so frequently asked –

What is Litigation?

Put simply, litigation is how we resolve civil disputes. This is best described with examples and so typical examples of civil disputes could be:

  • Unpaid bills
  • Reneging on a contract (professional services, trade or otherwise)
  • Disputes between landlords and tenants
  • Disputes between neighbours
  • Intellectual Property and Copyright disagreements
  • And so on.

There is no criminal law involved in the litigation process.  The police have not been involved and no one hurt;  it is the resolution of a disagreement between two parties.

What to expect from a litigation solicitor.

When you approach a legal firm such as Robertsons Solicitors for help in resolving a litigious issue you’ll initially receive advice as to whether you have a valid claim.  If it is believed that you do and that you have a case to win, evidence will be gathered to build your case.

At this point, court proceedings may be issued, or you may be advised by your solicitor that mediation may be a valuable solution that could protect your relationship with the other parties in the long run.  This is often desirable when dealing with neighbours, for example.

If court proceedings are the way forward, your litigation solicitor will represent you at court, brief barristers and provide them with the necessary assistance.
